Basics of Uncontested Divorce You Will Want to Know

When a married couple goes through a divorce, it will usually be categorized as either a contested divorce or an uncontested divorce. Most people understand that a contested divorce means the spouses cannot agree and might even be getting into heated arguments. But what does an uncontested divorce really mean and entail?

At a cursory glance, an uncontested divorce seems like a divorce that does not involve fights and arguments. However, the actual process of an uncontested divorce is so much more than that. Indeed, an uncontested divorce does not mean that you and your spouse do not argue, as this is probably going to happen for nearly every divorce.

Instead, an uncontested divorce occurs when the spouse receiving the divorce papers from the other agrees with all clauses and stipulations. For example, you work with a lawyer to decide how you would like your divorce to progress, considering all topics like child support, alimony, etc. The completed divorce paperwork is given to your spouse and they do not find any reason to change what you have proposed. This would lead to an uncontested divorce, unless something occurs down the line to change either of your minds.

You might also be able to achieve an uncontested divorce intentionally if you begin your divorce with collaboration and cooperation in mind. Mediation in particular is a useful family law process in which you and your spouse work together with a mediator to complete a divorce without contests and incidents.
